On February 6, 2019, the Department of Health and Human Services (Department or HHS) announced a proposed rule to amend the safe harbor regulation for prescription drug rebates and the creation of new safe harbor protection for certain point-of-sale reductions in price on prescription drugs and certain PBM manager service fees.
