The No Surprises Act, signed into law on December 27, 2020, prohibits balance billing members for certain out-of-network services. The Act includes a reimbursement settlement and arbitration process with strict timelines and expands the transparency requirements established by the Transparency in Coverage rules, finalized in October 2020.

Most sections of the legislation go into effect on January 1, 2022. The No Surprises Act is good news for patients, but many healthcare payers wonder whether they can ensure alignment and implement solutions by the effective date.
